Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of the Niftonic Sports mobile application and related services (collectively, the "Service") operated by Niftonic Private Limited ("Niftonic", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
Niftonic Sports is a platform that connects players with indoor sports venues and enables venue owners to list facilities, manage availability, and accept bookings. We provide the technology platform; sports facilities listed on the Service are operated by independent venue partners.
We may offer features including venue discovery, court booking, favorites, reviews, events, subscriptions, notifications, and business management tools. Features may change over time.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and complete.
3. Accounts
To access certain features, you must create an account using email, Google Sign-In, Apple Sign-In, or other supported methods. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You may register as a player ("customer") or venue owner ("business"). You agree to provide accurate profile and business information and to keep it up to date. You must notify us promptly of any unauthorized use of your account.
4. Bookings
4.1 Making a booking
When you book a venue through the Service, you enter into a reservation with the venue partner subject to their availability, rules, and policies. Booking details, including date, time, sport, price, and facility rules, are displayed before you confirm.
4.2 Cancellations and changes
Cancellation, rescheduling, and refund rules may vary by venue and are shown at the time of booking or on the venue listing. We are not responsible for a venue's failure to honor a booking, but we may assist with support requests where reasonably possible.
4.3 No-shows
If you fail to arrive for a confirmed booking, the venue may charge the full booking amount or apply penalties in accordance with its policy.
5. Payments and Subscriptions
Certain bookings, subscriptions, or premium features require payment. Payments are processed through Stripe or other authorized payment providers. By submitting payment information, you authorize us and our payment partners to charge the applicable fees, taxes, and charges.
Subscription plans, if offered, renew automatically unless cancelled before the renewal date through the app or applicable app store subscription settings. Prices and plan features may change with notice where required by law.
Promotional codes are subject to their stated terms and may be modified or withdrawn at any time.
6. Venue Owner Terms
If you list a facility on the Service, you represent that you have authority to offer the venue for booking and that your listing information is accurate. You are solely responsible for:
- Maintaining accurate availability, pricing, and facility details.
- Honoring confirmed bookings and providing the advertised facilities and services.
- Compliance with applicable laws, licenses, safety standards, and insurance requirements.
- Handling on-site operations, customer service, and any disputes with players.
We may remove or suspend listings that violate these Terms, applicable law, or our policies.
7. User Conduct
You agree not to:
- Use the Service for unlawful, fraudulent, or abusive purposes.
- Harass, threaten, or harm other users, venue staff, or third parties.
- Submit false bookings, fake reviews, or misleading listings.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Scrape, copy, reverse engineer, or interfere with the Service except as permitted by law.
- Use the Service in a manner that could damage, disable, or impair our systems.
We may investigate violations and take action including content removal, booking cancellation, or account suspension.
8. Reviews and Content
You may submit reviews, photos, feedback, and other content through the Service. You retain ownership of your content, but grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute it in connection with operating and promoting the Service.
You represent that your content is truthful, does not violate any third-party rights, and complies with applicable law. We may remove content that we reasonably believe violates these Terms or our policies.
9. Intellectual Property
The Service, including its design, software, logos, trademarks, and content provided by us, is owned by Niftonic Private Limited or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not operate sports facilities and do not guarantee the quality, safety, legality, or suitability of any venue, equipment, staff, or activity. Participation in sports activities involves inherent risks of injury. You assume all risks associated with using venues booked through the Service.
11. Limitation of Liability
To the fullest extent permitted by law, Niftonic Private Limited and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from your use of the Service or any booking, venue, or sports activity.
Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred US dollars (USD $100), except where such limitation is prohibited by law.
12. Indemnification
You agree to indemnify and hold harmless Niftonic Private Limited and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your bookings, your venue listings, your violation of these Terms, or your violation of any law or third-party rights.
13. Suspension and Termination
You may stop using the Service at any time and may delete your account through the in-app account deletion feature. We may suspend or terminate your access if you violate these Terms, create risk for us or other users, or where required by law.
Sections that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
14. Governing Law
These Terms are governed by the laws of Pakistan, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Pakistan, unless applicable consumer protection laws require otherwise.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
